Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act.

120 litres of country made liquor was recovered from the manufacturing site of the informant. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the alleged place from where the seizure was made belongs to the petitioner or petitioner was operating the said manufacturing unit.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.33326 of 2015 (2) dt.11-08-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Garkha P.S. Case No. 188 of 2013, pending in the Court of learned Judicial Magistrate, 1st Class, Saran, Chapra. Accordingly the application is disposed off.
