====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 447, 341 , 323 , 324, 325 , 307, 354 (B), 379, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of occurrence all the F.I.R named accused persons including this petitioner armed with lathi-danda, Khanti and iron rod abused and assaulted the family members of the informant and took away Rs. 25,000/- and mobile phone along with gold chain of his younger son.

4. It is submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner and no overt act is alleged against him. Case and counter case. Petitioner claims clean antecedent. Several Co-accused, with similar allegation, have already been allowed pre-arrest bail by

Patna High Court CR. MISC. No.57551 of 2024(2) dt.27-09-2024 2/2 this Court vide order passed in Cr.Mis.No. 51592/2023.

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate XI, Saran at Chapra in connection with Bheldi P.S. Case No. 258 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
