====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-04-2016 Heard the learned counsel for the petitioner and the learned counsel for the respondents.

It appears that the defence of the tenant-petitioner has already been struck off for non-compliance of the order under Section 15 of the B.B.C. Act. It is admitted fact that the defendantpetitioner is not disputing the relationship of landlord and tenant between the parties. He has filed the application to cross-examine two of the witnesses of the plaintiff after their discharge. The Court below by reasoned order rejected the said application considering the conduct of the petitioner.

Since the relationship of landlord and tenant is admitted and the defence has already been struck off, now there is no question to cross-examine the plaintiff's witnesses arises. Further, the Court below has assigned reasons for not allowing the application.

Patna High Court CWJC No.11349 of 2015 (2) dt.29-04-2016 Thus, I find no reason to interfere with the impugned order. Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Saurabh/- U T
