JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks bail in connection with Chautarwa P.S.Case No. 196 of 2018 registered under Sections 376D of the Indian penal Code and 8 of the POCSO Act. Allegation against the petitioner and other accused persons is of committing rape on the minor daughter of the informant.

Submission of learned counsel for the petitioner is that independent witnesses have stated before the police that son of the petitioner had met with an accident with the son of the informant and for that a Panchayati was held and Rs. 2 lacs was awarded against the informant and due to that reason the petitioner has been made accused in this case and medical report also does not support the prosecution case and he is in custody

Patna High Court Cr.Misc. No.69115 of 2018(3) dt.14-12-2018 2/2 since 27.08.2018. Learned counsel further submits that in this case final form has been submitted finding the case not true but cognizance has been taken.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 1st ADJ-cumSpecial Judge, West Champaran, Bettiah in connection with ChautarwaP.S. Case No. 196 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
