The present application has been filed for cancellation of regular bail granted to opposite party no. 2, vide order dated 21.02.2019, passed by learned Sessions Judge, Bhojpur, Ara, in B.P. No. 222 of 2019 in connection with Sahpur P.S. Case No. 302 of 2018 for the offence under Sections 302,120(B)/34 of the IPC and 27 of the Arms Act.

It is submitted by learned counsel for the petitioner that the bail application of other co-accused has been rejected by the same court i.e., learned Sessions Judge, Bhojpur, Ara. He further submits that the bail of co-accused Mukteshwar Mishra

Patna High Court CR. MISC. No.50164 of 2019(2) dt.16-08-2019 2/2 has been rejected also by a Bench of the Hon'ble Patna High Court vide Cr. Misc. No. 24313 of 2019 under order dated 08.07.2019.

Learned counsel for the petitioner seeks permission to withdraw the present application with a liberty to file a detailed application for cancellation of bail before the concerned court below.

Permission is accorded.

The present application stands dismissed as withdrawn with the aforesaid liberty.
