2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. That prosecution case in brief is that on the day of alleged occurrence informant's some amount was due on the petitioner about the filing sand. On 24.01.2024 informant went to demand of the said due amount but petitioner did not give due amount thereafter informant return back to his house on

Patna High Court CR. MISC. No.55599 of 2024(3) dt.01-10-2024 2/3 25.01.2024 at about 9:00 A.M. and 3 unknown persons armed with deadly weapon at the shop of the informant and started abusing when informant protested, then petitioner assaulted with 'dabiya' on the head of the informant and Jeebachh Sahani also assaulted with 'danda' to the informant. It is further alleged that when informant fell down then petitioners started pressing the neck and petitioner no. 1 snatched the gold chain from the neck of the informant and petitioner no. 2 snatched Rs. 5,000/- from the pocket of the informant.

Learned counsel for the petitioners submits that the entire prosecution story is false and concocted as the entire occurrence took place on 24.01.2025 and 25.01.2024 whereas the FIR has been lodged after delay of two days on 26.01.2024. Injury of informant is simple in nature. Petitioners have no criminal antecedent.

Considering the aforesaid facts and circumstances of the case and the petitioners have no criminal antecedent, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jhanjharpur, Madhubani in
