The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Ekma P.S. Case No.458 of 2024, lodged on 19.12.2024, under Sections 126(2/115(2)/109/303(2)/3(5) of the Bhartiya Nyay Sanhita, 2023, pending in the Court of Judicial Magistrate, 1st Class, Saran at Chapra.

3. As per the prosecution, FIR has been lodged against two named and one unknown accused persons. Allegation made in the FIR that three accused persons have surrounded the

Patna High Court CR. MISC. No.55876 of 2025(2) dt.27-08-2025 2/3 informant, snatched his key of his bike and snatched Rs.60,000/- from him. He identified two persons and disclosed the name of two persons.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that his antecedent is clean. He submits that in the order sheet it has wrongly been mentioned that para-38 of the case-diary indicates that petitioner has one criminal antecedent. He submits that one case is pending against third accused and not against the petitioner. He further submits that even on the merit of the case the allegations are of general and omnibus. There is no whisper against the present petitioner. As such, petitioner deserves anticipatory bail.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that specific allegation is against three persons and the allegation of snatching cash of Rs.60,000/- is there and in the FIR Section 3(5) of the Bhartiya Nyay Sanhita, 2023 has been added.

6. In this view of the matter, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused. However, in the event of surrender of the petitioner within six weeks from today,
