The petitioner apprehends his arrest in connection with Lahariasarai P.S. Case No. 05/2013 registered for the offences punishable under Sections 406, 420, 467, 468, 471/34 and 120B of the I.P.C.
Learned counsel for the petitioner submits that the allegation is against Md. Rizwan, who is said to have taken the money from the informant. So far as this petitioner is concerned, there is no whisper against him nor is their any statement against him. Learned counsel for the petitioner has submitted that the concerned transaction of earnest money was between the informant and the said Md. Rizwan.
Considering the aforementioned submissions and
Patna High Court Cr.Misc. No.33000 of 2015 (2) dt.20-08-2015 also the fact that main accused Md. Rizwan has been granted bail vide B.P. No. 93/2013 by the Court below, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 5/2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
