JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 The petitioner is in custody since 19.10.2016 in connection with Jainagar P.S. Case No. 85 of 2017, registered for offences punishable under Sections 20/22 of the Narcotic Drugs and Psychotropic Substance Act.

Allegation against the petitioner is of recovery of 5 kg of ganja.

It has been submitted on behalf of the petitioner that petitioner has nothing to do with the alleged recovery of ganja, in fact, petitioner runs a betel shop besides the house, from where the alleged recovery has been made. Petitioner has falsely been implicated in this case as he denied to become the seizure list witness. Further petitioner has been in judicial custody since 05.04.2017.

Patna High Court Cr.Misc. No.23562 of 2017 (4) dt.21-06-2017 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the fact that in this case huge quantity of ganja has been recovered and petitioner has been apprehended on spot, as such, I am not inclined to release the petitioner on bail, his prayer for regular bail is accordingly rejected.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible.
