2. The petitioner seeks regular bail in connection with Baheri P.S. Case No. 370 of 2026, registered for the offence under Sections 137(2), 96, 144(1) and 3(5) of the Bhartiya Nyaya Sanhita.

3. As per the prosecution case, on 22.05.2026, the victim who is a 16 years old girl, came to the informant's house and disclosed that she had escaped from the custody of the accused, where she was allegedly being forced into prostitution. Thereafter, on 28.05.2026, the victim allegedly went missing from the informant's house and, upon enquiry, it has been alleged that the accused along with his siter-in-law had abducted

Patna High Court CR. MISC. No.52626 of 2026(2) dt.29-07-2026 2/3 her in a vehicle. It has further been alleged that the victim was being wrongfully confined by the accused.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It has been further submitted that the petitioner is not named in the FIR and has been implicated only because he assisted his mother-in-law against whom the allegation has been levelled in the FIR. The allegations against the peitioner are false, concocted and devoid of merit. It is further submitted that no overt act has been attributed to the petitioner and there is no material to suggest his involvement in the alleged offense. It has been submitted by the learned counsel for the petitioner that the petitioner has three kids and there is nobody to look after them. It has been also submitted that the petitioner has only one criminal antecedent in which he has already been acquitted. It has lastly been submitted that the petitioner is in judicial custody since 01.06.206.

5. Per Contra, the learned APP for the State vehemently opposed the prayer for grant of regular bail.

6. Considering the aforesaid facts and circumstances of the case and also the fact that there is no

No.52626 of 2026(2) dt.29-07-2026 3/3 specific allegation against the petitioner as well as the petitioner has not named in the FIR as accused, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Behri P.S. Case No. 370 of 2026.
