JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47 (a) of the Bihar Excise Act.

Prosecution case is that 40 liters country made liquor were recovered from the possession of the petitioner. It is submitted by the learned counsel for the petitioner that he was not arrested on the spot and nothing incriminating has been recovered from his possession.

The aforementioned facts constitutes a good ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Trial No. 1215 of 2015

Patna High Court Cr.Misc. No.32436 of 2015 (2) dt.10-08-2015 2/2 pending in the Court of Chief Judicial Magistrate, Motihari, East Champaran.

With the observations above, the application stands disposed off.
