1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Dhaka P.S. Case No. 404 of 2022 registered for the offence punishable under Sections 380, 411, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of committing theft in the shop of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 03.05.2024.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, Motihari in connection with Dhaka P.S. Case No. 404 of 2022.

7. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Dhaka Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) kiran/- U T
