This is an application for bail in connection with Sonepur Hajipur Rail P.S.Case No. 79 of 2016 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that though the petitioner has been apprehended at the spot but the petitioner is in custody for about four months. Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the fact that the petitioner has been arrested at the spot and has remained in custody for four months, the learned court below is directed to
Patna High Court Cr.Misc. No.54209 of 2016 (3) dt.03-02-2017 2/2 expedite the trial and conduct the trial on day-to-day basis and try to conclude the same within six months. If the trial is not concluded within six months, the petitioner will be at liberty to renew his prayer for bail.
Accordingly, this application is dismissed.
