The petitioner seeks regular bail in Jogbani P.S. Case No. 240/2018, Special (Drugs) Case No. 03/2018, registered for the offences punishable under Section 414 and 34 of the Indian Penal Code and sections 27(b), 28 and 36 of Drugs and Cosmetics Act.
Learned counsel for the petitioner has submitted that in the written report it is alleged that 1728 tablets of Sposmd Proxyvom Plus of smack, Nepali currency of Rs. 65,725/- and Rs. 7910/- Indian currency and mobile were recovered from a vehicle which was having Nepali number. The person riding the motorcycle managed to run away. The petitioner was caught hold by the police. In this manner, there is no recovery of any
Patna High Court Cr.Misc. No.73260 of 2018(2) dt.10-12-2018 2/2 incriminating article from possession of the petitioner. He is in custody since 03.09.2018 having clean antecedent. Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Ist-cum-Special Judge, Araria in connection with Jogbani P.S. Case No. 240/2018, Special (Drugs) Case No. 03/2018.
