Petitioner seeks bail in Manjhi P.S. Case No.196 of 2018 instituted for the offence under Section(s) 188, 420, 120-B Indian Penal Code and Sections 30, 30(a), 38 of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that police intercepted a truck and recovered 5274 litres foreign liquor from the truck. It is further alleged that petitioner along with Sukhdeo Singh was found sitting in the aforesaid vehicle. Counsel for the petitioner submits that petitioner has been falsely implicated in this case. He is said to be sitting in Truck, but there is no signature of the petitioner on the seizure list. Seizure List is part of the First Information Report, which

Petitioner is in custody since 28.07.2018 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ VI cum Special Judge, Excise Act, Saran at Chapra, subject to the condition that both the bailors shall be close relative of the petitioner.
