The petitioner seeks bail in connection with Maheshkhut P.S. Case No.52 of 2015/G.R. No.988 of 2015 registered under Section 394 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the petitioner was apprehended by the police in connection with Naugachia P.S. Case No.74 of 2015 in which the police got recorded the confessional statement of the petitioner showing his involvement in the present case. Later on, it is also stated that the petitioner was identified by the photograph on

Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. Further submission is that the informant has detailed the physique of the culprit in the F.I.R. but the petitioner was not put on T.I. Parade while the petitioner is in custody since 01.10.2016. While the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, but the petitioner is on bail in all the four cases.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Khagaria, in connection with Mahesh Khunt P.S. Case No.52 of 2015/G.R. No.988 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. Further, the petitioner shall attend the trial court on each and every date, as fixed by the trial court, in the case during the course of the trial. If the petitioner fails to attend the trial court on two consecutive dates without any reasonable cause being
