The petitioners are accused in connection with Barachatti P.S. Case No. 388 of 2016, registered under Sections 272, 273 and 120(B) of the Indian Penal Code and Section 47(A), 48(2), 63 of the Bihar Excise Amendment Act, 2016. The accusation is of recovery of five cartons, each containing 48 bottles, containing 180 ML each, of India made foreign liquor in a vehicle, which was being driven by this petitioner.

Learned counsel for the petitioner submits that, in fact, the petitioner is the driver, who used to drive the commercial vehicle and he had no knowledge about loading of

Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the ACJM, Sherghati, Gaya in connection with Barachatti P.S. Case No. 388 of 2016.
