JUSTICE SANJAY PRIYA ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Shrinagar P.S. Case No. 12 of 2017 instituted for the offence under Sections-457 & 380 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the written report. The name of the petitioner has been disclosed by two witnesses namely, Lelhu Yadav and Surendra Yadav at paragraphs-9 & 20 of the C.D. after about 13 days of the occurrence.

The written report is against unknown.

Learned APP has referred paragraphs-9 & 20 of the C.D. wherein witnesses namely, Lelhu Yadav and Surendra Yadav have raised mere suspicion against this petitioner.

No.19068 of 2017 (3) dt.22-06-2017 2/2 In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shrinagar P.S. Case No. 12 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Madhepura subject to condition that both the bailors should be close relatives of the petitioner.
