This application for anticipatory bail arises out of Surajgarha P.S. Case No. 132 of 2018, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code but subsequently Section 302 of the IPC has been added. Learned counsel for the petitioner appears to be correct in his submission that there is nothing to distinguish the case of the petitioner from the cases of other two accused persons, namely, Satya Narayan Saw and Vibhishan Kumar @ Bhabhishan who have been allowed anticipatory bail by this Court vide orders dated 26.10.2018 and 14.05.2019 passed respectively in Cr. Misc. No. 64396 of 2018 and 22680 of 2019. There is no allegation of specific overt act against these

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in Surajgarha P.S. Case No. 132 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
