The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 151, 152, 153, 171F, 186, 188, 332, 333, 337, 338, 323, 353, 379, 307, 385, 341, 504, 427, 120B of the Indian Penal Code and Section 3 of Damage to Public Property Act.

The prosecution case is that co-accused Heera Lal Das contested the election for the post of Prakhand Pramukh, Pandaul Block in the district of Madhubani and was defeated by one vote by one Sudhir Kumar Chaudhary. It is

Patna High Court Cr.Misc. No.33901 of 2015 (2) dt.13-08-2015 2/2 alleged that co-accused Heera Lal Das provoked his supporters taking a plea of corruption and thereafter the supporters, five hundred in number, including 11 FIR named accused persons, raised slogans and destroyed public property. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and the petitioners have no criminal antecedent. Moreover, co-accused Heera Lal Das has been granted anticipatory bail vide Cr. Misc. No. 45966 of 2013.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 181 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
