Petitioner apprehends arrest in connection with Sursand P.S. Case No. 400 of 2020 registered for the offence punishable under sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is neither the owner of the vehicle in question nor has any concern with the seized illicit liquor. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.64951 of 2021(2) dt.29-04-2022 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Sitamarhi in connection with Sursand P.S.

Case No. 400 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
