JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks regular bail in connection with Sasaram (Model) P.S. Case No. 668 of 2017, registered for offences punishable under Sections 302 and 120(B) of the Indian Penal Code.
Allegation as per F.I.R. is that while the informant and his brother Rinku Khan was going to their village from tempo, the petitioner and others came on motorcycle and surrounded them and after stopping the Tempo, co-accused Kallu Khan fired upon the brother of informant, causing injury to him, who later on succumbed to his injury.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and the F.I.R. itself shows that the petitioner is not the assailant. Further he

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (Model) P.S. Case No. 668 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
