Petitioner seeks bail in K. Hat (Sahayak) P.S. Case No.592 / 2018 registered for the offence punishable under Sections 406, 420, 414 & 379 of the Indian Penal Code. Informant is the Police Officer who has stated that on secret information received by him, he apprehended this petitioner and upon his search, 35 ATM cards of different banks were recovered from his possession.

It has been submitted that petitioner is innocent and the ATM cards recovered from his possession belong to his friends and he has not used the ATM cards for any obli.que purpose. There is no complaint against him of withdrawing any money from the said ATM cards. Petitioner has no criminal antecedent

Patna High Court Cr.Misc. No.73022 of 2018(2) dt.13-12-2018 2/2 and is in custody since 21.08.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with K. Hat (Sahayak) P.S. Case No.592 / 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offences, after his release on bail the trial court shall take steps to cancel his bail bond. (S. Kumar, J) Sanjay/- U T
