The petitioner apprehends his arrest in connection with Kursakata (Sonamani Goddam) P.S. Case No 12/2015 registered for the offences punishable under Sections 341/323/ 354(A)/379/ 376 /34 of the Indian Penal Code and Section 4/8 of POSCO Act. Learned counsel for the petitioner submits that the present case is out and out falsity and the petitioner has been roped only because he was getting married with some other women whereas the informant wanted to marry him. It is also submitted that the allegation levelled under the POSCO Act is also frivolous and not a reality.
Patna High Court Cr.Misc. No.32729 of 2015 (3) dt.29-03-2016 P2/2 Learned counsel appearing on behalf of the informant, however, submits that the present petitioner has been forcing himself on the minor girl under false assurance and, thereafter, she filed the case when she found that the boy in question was not willing to marry her.
Considering the nature of allegations and that the girl is a minor, I am not inclined to grant anticipatory bail to this petitioner. The prayer for bail is dismissed. (Anjana Mishra, J) Saif/- U T
