JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. None has seen the actual killing of the deceased and the prosecution case is based on circumstantial evidence. No doubt, petitioner is named in the first information report but only suspicion has been raised against him.

Learned counsel for the petitioner submits that having similar allegation, several co-accused have already been granted privilege of bail by a co-ordinate Bench of this Court but the bail petition of the petitioner was rejected by the learned court below only on the ground that he could be remanded in this case after two years of institution of the present case. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.25994 of 2016 (3) dt.04-07-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VII, Danapur at Patna in connection with Session trail no. 541 of 2015 arising out of Maner P.S.Case No.311 of 2014.
