JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-01-2022 Heard Mr. Rajesh Kumar, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Laheriasarai P.S. Case No. 456 of 2019 instituted for the offences under Sections 307, 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

In view of the accusation against the petitioner of assaulting the deceased, I am not inclined to grant him the privilege of anticipatory bail.

The prayer for grant of anticipatory bail to the

Patna High Court CR. MISC. No.14549 of 2021(2) dt.03-01-2022 2/2 petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, the Court below shall consider his case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
