JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 427 & other minor sections of the Indian Penal Code.
Petitioner is named in the first information report but according to prosecution case itself, more than 100 persons assaulted the deceased, when the deceased met an accident, causing death of a person.
No specific overt act has been attributed against the petitioner, who is languishing in jail custody since 09-01-2016. The investigation against the petitioner has already been completed and the petitioner does not have any criminal

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jehanabad P.S. Case No. 46 of 2015 to the satisfaction of Chief Judicial Magistrate, Jehanabad.
