The petitioner seeks regular bail in connection with Mohania P.S. Case No. 172 of 2017, G.R. No. 872 of 2017 for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

The case of the prosecution is that six unknown accused persons had entered into the hotel premises and engaged in loot and assault on the employees of the hotel of the informant. It is further alleged that the accused persons had taken away the mobile phones of the employees. The learned counsel for the petitioner has submitted that neither test identification parade has been conducted nor any recovery has been made from the possession of the

It is further submitted that the petitioner is having a fair antecedent, barring one case in which the petitioner is on bail. The petitioner is stated to be languishing in custody since 27.08.2018, Lastly, it is submitted that similarly situated accused person has already been granted bail by this Court by order dated 04.12.2018 passed in Cr. Misc. No. 71051 of 2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S.
