The petitioners seek bail in Kathaiya P.S. Case No. 79 of 2019, instituted for the offence under Section (s) 399, 402, 414 of the Indian Penal Code, Sections 25(1-b)(a), 26 and 35 of Arms Act.

Counsel for the petitioners submits that four accused persons as named in the written report were apprehended by the police. They disclosed the name of petitioners and other accused persons who fled away from the place of occurrence. He further submits that during investigation two Mobile Phones have been recovered from possession of petitioners

Patna High Court CR. MISC. No.51176 of 2019(2) dt.21-08-2019 2/2 which finds mentioned in the seizure list.

Petitioners are in custody since 25.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, Distt. Muzaffarpur, in connection with Kathaiya P.S. Case No. 79 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
