The petitioner was granted provisional bail vide order dated 31.08.2016 passed in I.A. No. 1742 of 2016 on the ground that his son has been suffering from Bone Marrow Cancer and for his treatment, he has an appointment at Dr. Ram Manohar Lohia Hospital, Delhi, for 06.09.2016. The said provisional bail was granted to him for a period of five weeks and the matter was to be posted after six weeks. In the meantime the petitioner was also directed to file surrender certificate after availing the privilege for five weeks. When the matter was called out, the Counsel instead of filing of surrender certificate seeks a further adjournment. Considering the fact that the petitioner has failed to

No.25530 of 2016 (6) dt.26-10-2016 2/2 comply with the order of this court dated 31.08.2016, I find no ground for extending the privilege of provisional bail granted to the petitioner. Hence, I.A. No. 1742 of 2016 along with the present application stands rejected and the provisional bail granted to the petitioner is cancelled in connection with Sessions Trial No. 879 of 2014, corresponding to Kasim Bazar P.S. Case No. 47 of 2014, pending in the court of learned Additional Sessions Judge-II, Munger.

The petitioner is directed to surrender before the court below within a period of four weeks from the date of receipt/production of copy of the order, failing which, the court below shall take all necessary steps to ensure his appearance in the concerned Court.
