Petitioner took Rs. 30,000/- and one Laptop from the informant with assurance that he would get a permanent centre of Adhar Card opened for the informant but, subsequently, he refused to return the amount and did nothing. Submission on behalf of the petitioner is that even if prosecution story is assumed to be true, then also, at best, it is a case of civil dispute and, moreover, petitioner is in jail custody since 05.04.2016 without having any criminal antecedent.
