Petitioner seeks bail in Mithanpura P.S. Case No.102 of 2018 instituted for the offence under Section(s) 379, 411/34 Indian Penal Code.

In the written report, it is alleged that while informant was travelling in Auto, one person, who was sitting in Auto, snatched the mobile and fled away. After two days of the occurrence, petitioner was arrested on the basis of identification made by the informant. It is alleged that mobile has been recovered from his possession.

Counsel for the petitioner submits that Petitioner is in custody since 11.04.2018 having clean antecedents. No Test Identification Parade of the mobile has been held by the police

Patna High Court Cr.Misc. No.72156 of 2018(3) dt.21-12-2018 2/2 till date.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, East, Muzaffarpur, in connection with Mithanpura P.S.
