Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 457 and 380 of the Indian Penal Code and subsequently added Section 411 of the IPC, registered in connection with Muffasil P.S.Case no. 324 of 2021. When the informant awoke, he found the lock of his gate was broken and the entire articles were scattered. He found that some ornaments mentioned in the FIR and other articles were missing. He suspected one Sonu Kumar and Vipul Kumar, the neighbours, to have complicity in the occurrence. The learned counsel for the petitioner has submitted that he is not named in the FIR. Patna High Court CR. MISC. No.63209 of 2021(2) dt.19-07-2022 2/2 articles from the shop of the petitioner but at the relevant time he was not present at his shop, rather his younger brother was there and seizure list contains the signature of his younger brother.

The learned APP has opposed the prayer for bail. Considering the above facts and circumstances, especially the clean antecedents of the petitioner, let him abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai Muffasil P.S.Case No. 324 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
