JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioner seeks regular bail in connection with Nathnagar (Lalmatia) P.S. Case No. 510 of 2017, registered for offences punishable under Sections 366(A)/120B of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that there was love affair between the petitoner and the daughter of the informant and he has falsely been implicated in this case and although her statement under Section 164 Cr.P.C. shows that she was given a biscuit to eat by the petitioner and, thereafter, she fell unconscious and regained the consciousness in Allahabad. However, the girl in her statement has admitted

Patna High Court Cr.Misc. No.70182 of 2018(2) dt.06-12-2018 2/2 that no physical assault has been done by the petitioner. Further petitioner has no criminal antecedent and has been in judicial custody for more than a year.

Learned counsel for the State opposed the prayer for bail on the ground that the girl is minor.

Having heard both sides, considering the facts and circumstances of the case and also the period of custody of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - I, Bhagalpur, in connection with Nathnagar (Lalmatia) P.S. Case No. 510 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
