The petitioner seeks bail in connection with Sidhwalia P.S. Case No.71 of 2016 registered under Sections 366 of the Indian Penal Code.
The accusation is that this petitioner used to come at the house of the informant Anil Sharma and talked his wife Urmila Devi. On 12.06.2016, Urmila Devi, the wife of the informant, left the house alongwith her children without giving information to the informant. The informant raised suspicion against the petitioner of having her hand in inducing away his wife. Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.598 of 2017 (3) dt.30-01-2017 2/2 submits that, in fact, the petitioner is the cousin sister of the informant and has falsely been implicated in this case. While Urmila Devi, the wife of the informant, in her statement recorded under Section 164 of the Code of Criminal Procedure, has stated that this petitioner being the Nurse assured her to provide job of Nurse and, thereafter, she went to Motihari where she stayed about 20 days with the petitioner but this petitioner asked her to develop physical relation with others but, anyhow, she succeeded to flee away from there. The petitioner being lady is in custody since 02.09.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Gopalganj, in connection with Sidhwalia P.S.
