The petitioner seeks bail in Nathnagar (Madhusudanpur) P.S. case No. 278 of 2018 registered under Section 307 and other sections of the Indian Penal Code and under Section 25(1-b) a 26/27/35 of Arms Act. The informant alleged that he was driving the tractor and trailor loaded with bricks but some boys came and intercepted the tractor. One of them opened fire but the informant saved himself. On hearing the sound of firing many persons came and apprehended one of the accused who disclosed his name as Sintu Yadav, the petitioner, and he also disclosed the name of other accused persons. From the possession of petitioner one country made pistol was recovered. The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.73741 of 2018(2) dt.13-12-2018 2/2 petitioner is alleged to have fired but there is no recovery of empty cartridge from the place of occurrence. Nobody was injured and petitioner is in custody since 06.05.2018. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the lime amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. case No. 278 of 2018.
