Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Darpa P.S. Case No. 51 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 387, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioners has submitted that there is case and counter case. The petitioners are the
Patna High Court CR. MISC. No.53153 of 2022(2) dt.25-01-2023 2/2 persons of clean antecedent and the injuries are simple in nature. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul in connection with Darpa P.S. Case No. 51 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
