The petitioner has filed this writ petition for quashing the order dated 16.2.2017 as contained in Memo No.338 by which the District Magistrate, Gopalganj put the petitioner under suspension contemplating departmental proceeding on the allegation that petitioner connived with other accused persons who was selling country made liquor.

Learned counsel for the petitioner submits that the petitioner was suspended on nonest ground but it appears that the memo of charge has already been framed and the departmental proceeding has been initiated. Therefore, I do not find any force in the submissions of the learned counsel for the petitioner. The

Patna High Court CWJC No.10907 of 2017 (4) dt.14-09-2017 2/2 petitioner being Chaukidar connived with other persons who was illegally selling country made liquor.

Accordingly, this writ petition is dismissed as devoid of merit but the respondents are directed to conclude the departmental proceeding within six months from the date of receipt of this order.
