JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2018 Heard Sri Manmohan Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody since 18.09.2018 in connection with Govindpur P.S. Case No. 176 of 2018 registered for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016 has prayed for grant of bail. By way of referring to the F.I.R. learned counsel for the petitioner submits that petitioner was only driver of a vehicle and the said vehicle was intercepted by Police and owner of the vehicle was also there who was also arrested. It has been argued by learned counsel for the petitioner that being driver he was not aware as to whether the owner of the vehicle had loaded such liquor to the tune of 200 liters. It has also been argued that petitioner is having clean antecedent which fact has been stated

Considering the nature of accusation and clean antecedent of the petitioner which fact has been mentioned in paragraph 3 of the petition , let the petitioner - Jitu Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.D.J. II - cum- Special Judge, Nawada / concerned court in connection with Govindpur P.S. Case No. 176 of 2018 .
