Petitioner is accused in connection with Chausa P.S. Case No. 108 of 2015 registered under Sections 363/366(A)/34 of the I.P.C.

The accusation is of kidnapping of grand-daughter of the informant by this petitioner with the help of others on 12.10.2015 on the way to school.

Learned counsel appearing on behalf of the petitioner submits that the petitioner and the victim, daughter of the informant, belonged to the same village and there was a love affair in between them. The victim left her house according to her sweet will. The victim, in her statement under section 164 Cr. P.C.,

Patna High Court Cr.Misc. No.29056 of 2016 (2) dt.20-07-2016 2/2 stated that the petitioner along with three kidnapped her causing assault through slaps and to keep her in the house of his brotherin-law but she did not disclose about commitment of rape. Further submission is that in medical examination, the age of the victim has been assessed between 14-16 years.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Uda Kishunganj, Madhepura in connection with Chausa P.S. Case No.108 of 2015.
