Petitioner apprehends his arrest in Sakra P.S. Case No.22 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

The S.H.O. of Sakra P.S. got secret inputs that Rakesh Singh used to keep liquor in his house and sells the same. On such information, a raid was conducted. Two persons started fleeing away. One person, Rakesh Singh was apprehended. On search, huge quantity of Imperial Blue and other brands of whiskey was recovered from the hut of Rakesh Singh. Rakesh Singh disclosed that his nephew Santosh Singh @ Santosh Kumar managed to flee away.

No.50246 of 2019(2) dt.13-08-2019 2/2 Learned counsel for the petitioner submits that petitioner is of course the nephew of Rakesh Singh but there is no material to show that Santosh Singh @ Santosh Kumar also assisted his uncle Rakesh Singh in illegally selling the liquor. Petitioner is living separately from his uncle. Petitioner has got no criminal antecedent.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S. Case No.22 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
