2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118(2), 76, 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita.
3. As per F.I.R., on 14.02.2025 at about 6 PM, wife of informant had gone to bring fire-wood, in the meantime, petitioner no. 1 came and caught her from behind and thereafter, tried to outrage her modesty, however, on alarm being raised by
Patna High Court CR. MISC. No.51374 of 2025(3) dt.02-09-2025 2/3 her, the informant came there and petitioner no. 4 fled away from spot. It is further alleged that after some time, petitioner no. 4 alongwith other petitioners, armed with deadly weapons, abused and assaulted informant and his brother, on account of which, both sustained injuries.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. The present case is counter blast of Shahkund P.S. Case No. 28 of 2025, which was lodged from petitioners' side against informant and others and after lapse of 15 days, the present F.I.R. has been lodged. Injuries, allegedly caused by petitioners, are simple in nature. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 2nd, Bhagalpur in connection with Shahkund P.S. Case No. 31 of 2025, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha
