The petitioner seeks bail in connection with Sursand P.S. Case No. 240 of 2021 registered for the offences punishable under Sections 8, 20(b)(ii)(B) of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.05.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 500 grams of charas along with mobile from the petitioner and two kg ganja is alleged to have been recovered from the co-accused Shamim Ansari. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case,
Patna High Court CR. MISC. No.62982 of 2021(2) dt.25-03-2022 2/2 nothing was recovered from his possession and there was violation of the provisions of N.D.P.S. Act in search and seizure of the alleged narcotics.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that there is allegation of 500 grams of charas from the petitioner. Considering the fact that there is allegation of recovery of charas weighing 500 grams from the petitioner, the Court, for the present, is not inclined to grant bail to the petitioner.
