JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-12-2018 Heard learned counsels for the petitioners and State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the IPC.
The prosecution case, as per the written report of Nishakar Tiwari, dated 14.05.2018 submitted to the Station House, Shahpur Police Station, is to the effect that petitioner no.1, Dadan Tiwari sold the share of land of the informant. Petitioner no.2 is the witness of the sale deed.
It is submitted by learned counsel for the petitioners that the petitioners are the agnate of the informant. It is further submitted that petitioner no.1 has sold his own share of land and earlier also similar nature of case has been lodged by the
Patna High Court Cr.Misc. No.69946 of 2018(2) dt.05-12-2018 2/2 informant wherein the petitioners have been granted bail. Learned APP submits that there is specific accusation against the petitioners.
Considering the nature of accusation being levelled in the background of dispute with regard to the share of land and pending Title Suit No. 197 of 2017, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned ACJM-XIV, Ara in connection with Shahpur P.S. Case No.134 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
