Petitioner, who is in custody, seeks bail in connection with Gayghat P.S. Case No. 258 of 2018 registered for the offences punishable under Sections 414/34 of the Indian Penal Code and under Section 25(1-b) (a), 26 and 35 of the Arms Act.
FIR has been instituted by a police officer in which he has stated that on a confidential Information that some criminals have assembled to commit some grave crime. He reached at the place of occurrence and signal was given to stop the car, three criminals tried to flee away, however, two were apprehended after chase however one managed to escape. Form possession of one of the
Patna High Court Cr.Misc. No.69528 of 2018(2) dt.04-12-2018 2/2 accused one loaded pistol and Samsung mobile was recovered and from the possession of the petitioner one mobile was recovered.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case and he was passing from that place and was arrested on suspicion. He has no criminal antecedent and he is in custody since 03.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Gayghat P.S. Case No. 258 of 2018.
