JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The informant claims in his ferdbeyan that three to four months prior to the alleged occurrence petitioner had given threatening of dire consequences to the deceased and on the basis of aforesaid circumstance, the informant doubted the hands of the petitioner in the present crime but the informant himself admitted in his ferdbeyan that at the time of alleged occurrence petitioner was in jail custody.

From perusal of the impugned order, I find that

Patna High Court Cr.Misc. No.27329 of 2016 (3) dt.22-07-2016 2/2 except the aforesaid material, the investigating officer failed to collect any other material to show the involvement of the petitioner in the present crime. Moreover, the investigation against the petitioner has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Abhishek Kunal, Judicial Magistrate 1st Class, Gopalganj in connection with Phulwaria P.S.
