2. The petitioner seeks bail in connection with Bikram P.S. Case No. 398 of 2024 registered for the offence under Section 80(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner, who is the husband of the deceased, is alleged to have killed the deceased.

4. The petitioner is in custody since 12.12.2024.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the deceased has committed suicide and the child born out of the wedlock is staying with the family of the petitioner.

6. Considering the aforesaid facts, this application

Patna High Court CR. MISC. No.51264 of 2025(3) dt.15-10-2025 2/2 is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, VI, Danapur, Patna/concerned Court below in connection with Bikram P.S. Case No. 398 of 2024.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner is directed to verify the fact that whether the child born out of the wedlock of the petitioner and the deceased is staying with the family of the petitioner or not. It is made clear that the bail bonds of the petitioner shall only be accepted if the child is staying with the family of the petitioner.
