The petitioner seeks regular bail in connection with Basbagu P.S. Case No. 62 of 2018 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and 414 of the Indian Penal Code.

The allegation is regarding recovery of 15 liters of illicit liquor from the motorcycle of the petitioner herein. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 01.09.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.72653 of 2018(2) dt.13-12-2018 2/2 case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Saharsa in connection with Basnahi P.S. Case No. 62 of 2018.
