The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on receiving secret information about the accused persons having gathered and planning to give effect to an occurrence, it is stated that a raid was conducted and seven accused persons including the petitioner herein were caught. It is further stated that incriminating articles were recovered from the possession of the other accused persons.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.63323 of 2021(2) dt.15-04-2022 2/2 that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 24.8.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 7 months and investigating in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Patepur P.S. Case no. 179 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Vaishali at Hajipur.
