JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner is in jail since 07.02.2016 in a case registered under Section 17 (I) (ii) of C.L.A. Act. The petitioner is not named in the first information report but from perusal of paragraph No.10 of the petition, it would appear that in course of investigation the name of the petitioner surfaced in confidential information received by the police and the aforesaid fact has been incorporated by the Investigating Officer in paragraph No.33 of the case diary. Learned counsel for the petitioner submits that except the aforesaid material, there is nothing against the petitioner and moreover, the F.I.R. named accused have already been granted

Patna High Court Cr.Misc. No.28071 of 2016 (4) dt.03-08-2016 the privilege of bail.

It is further submitted by learned counsel for the petitioner that although the present case is of the year 2006, but the petitioner has been remanded in this case in the year 2016 itself. However, in the present case, there appears to be nothing against the petitioner and he does not have any criminal antecedent.

Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M. Sherghati at Gaya in connection with Barachatti P.S. Case No. 19 of 2006. (Hemant Kumar Srivastava, J) V.P.Sinha/- U
